1. Oorzaak/noodzaak
Na meerdere voorvallen van vandalisme is besloten tot aanschaf en in gebruikstelling van cameratoezicht bij onze kantine onder de overkapping. Dit protocol geeft onder andere een beschrijving van de praktische uitvoering van het cameratoezicht mede met het oog op de bescherming van de privacy van de bezoekers van ons complex. Het cameratoezicht geschiedt onder de verantwoordelijkheid van het bestuur van de vereniging.
2. Doelstelling
Het cameratoezicht zal daarnaast, door de preventieve werking die er vanuit gaat, rust en een gevoel van veiligheid creëren onder de bezoekers. Daarnaast zal het cameratoezicht in geval van incidenten duidelijkheid kunnen verschaffen over de toedracht en daarmee samenhangend met een goede afhandeling daarvan.
Concreet wordt het camerabewakingssysteem ingezet voor:
- Het verhogen van het algemene veiligheidsgevoel van de bezoekers;
- Het beschermen van eigendommen;
- Het voorkomen/minimaliseren van overlast;
- Het voorkomen/minimaliseren van vernieling en vandalisme;
- Het voorkomen/minimaliseren van criminele activiteiten;
- Het ondersteunen van private- en strafrechtelijke procedures.
3. Privacy
De camera werkt 24 uur per dag en geeft een bewegingsalarm bij beweging onder onze overkapping en het pad hier net voor. De beeldinformatie wordt digitaal vastgelegd en is daarmee een persoonsregistratie in de zin van de wet. De inzet van de camera’s vereist dan ook een integer gebruik en een uiterste bescherming van de privacy. Het bestuur zal zeer zorgvuldig omgaan met de beelden om de privacy van de bezoekers te waarborgen. Opgenomen beelden zullen op geen enkele wijze door de vereniging worden verspreid. Binnen het bestuur is 1 persoon verantwoordelijk, die de beelden binnen krijgt en kan zien. Via de website van de vereniging wordt dit protocol ter beschikking gesteld aan ieder die daarin geïnteresseerd is.
Het bestuur van de vereniging heeft bij het algemene toegangshek een bordje op het hek bevestigd en stickers op de deur van de kantine waaruit blijkt dat er een camerabewakingssysteem gemonteerd is. De beelden worden enkel en alleen gebruikt voor het bovengenoemde doel.
4. Procedure en bevoegdheden
De beelden kunnen slechts in de volgende gevallen bekeken en veiliggesteld worden voor onderzoek:
- Indien er een overtreding heeft plaatsgevonden van het Huishoudelijk Reglement;
- Indien er een strafbaar feit plaats heeft gevonden.
Afhankelijk van de aard van de overtreding worden de volgende acties ondernomen:
- Overtreding van het huishoudelijk reglement (HR): het bestuur van de vereniging neemt contact op met de bezoeker. De bewuste bezoeker(s) of aannemelijk aan de bezoekers gelieerde overtreder wordt door het bestuur op het gedrag aangesproken, op voorwaarde dat de camerabeelden een duidelijk signalement laten zien.
- Opgenomen beelden kunnen worden getoond aan de personen die op deze beelden voorkomen en afgehandeld.
- Vernieling en overige criminaliteit: het bestuur van de vereniging doet altijd aangifte bij de politie. Beelden worden aan de politie overgedragen. Het bestuur van de vereniging verhaalt de kosten van herstel zoveel als mogelijk op de dader.
Bevoegd tot het bedienen van de opnameapparatuur is 1 bestuurslid van de vereniging. Deze persoon is bevoegd opnames veilig te stellen op daarvoor bedoelde media of op papier.
In verband met privacy zullen de beelden slechts dan bekeken en veilig gesteld worden als er geen andere personen aanwezig zijn dan de bedieningsbevoegde persoon en eventueel de vragende opsporingsambtenaar.
Iedereen die gefilmd wordt, heeft recht op inzage in de beelden. Om dit recht uit te oefenen volstaat een gemotiveerd verzoek aan het bestuur van de vereniging. Er kan alleen aanspraak gemaakt worden op beelden van de persoon waar het verzoek van afkomstig is. De beelden worden alleen na vertoon van geldige legitimatie overgedragen.
Het bekijken door en leveren van beelden aan politie/justitie vindt pas plaats na ontvangst van de schriftelijke vordering daartoe door de Officier van Justitie.
5. Installatie en bewaarduur
De beelden die gemaakt zijn door de camera komen binnen op een device van een bestuurder. Deze beelden worden maximaal bewaard tot de eventuele dader is achterhaald en de aangifte is afgehandeld. Overige beelden worden maximaal 14 dagen na opname verwijderd.
5. Klachten
Klachten aangaande de camerabeveiliging en afhandeling van verzoeken om inzage en verstrekking dienen te worden ingediend bij het bestuur van de vereniging. Wanneer in onderling overleg niet tot een oplossing wordt gekomen kan de betrokkene besluiten zijn klachten ter bemiddeling voor te leggen aan het College Bescherming Persoonsgegevens.
8. Slotbepaling
Als om een dringende reden van het protocol moet worden afgeweken, is het bestuur van de vereniging bevoegd om hiertoe een besluit te nemen.
